BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: A tract of land located in the 2400 block of 6th Avenue and 8th Avenue, and the 2400 and 2500 blocks of 7th Avenue, being lots 3, 4, and 14-22, block C, and lots 1-13, 16, and 17, block D, Hagan's Subdivision, plat book 2, page 33, ROHC and lots 5-8, Fox's Addition to Block C, Hagan's Subdivision, plat book 4, page 38, ROHC; being properties described in deed book 2618, page 950, ROHC, deed book 2617, page 932, ROHC, deed book 2790, page 112, ROHC, deed book 5080, page 758, ROHC, deed book 2785, page 73, ROHC, deed book 5046, page 776, ROHC and deed book 5086, page 79, ROHC. Tax Map No. 156J-G-8-18, 31, 32, 48, 49, and 51. from R-3 Residential Zone and M-2 Light Industrial Zone to M-1 Manufacturing Zone. SECTION 2. BE IT FURTHER ORDAINED, That this rezoning shall be subject to the following conditions: 1. Landscaping in accordance with the landscape ordinance (Ordinance No. 10692 adopted by the City of Chattanooga on April 21, 1998); 2. R-3 zoning is retained on the west 18 feet of property abutting Sixth Avenue; 3. The applicant will provide dense landscaping in accordance with the Landscaping Ordinance of at least 15 feet in depth from the CHA security fence along Sixth Avenue, sufficient for East Lake Courts residents to avoid unsightly expanses of parking lots and vehicles; 4. No access will be permitted from the applicant's property to Sixth Avenue, and the CHA's security fence will be allowed to remain in place on a permanent easement; 5. The applicant will provide landscaping in accordance with the Landscape Ordinance and cooperate with CHA in providing security along the southern edge of the Fulmer property adjacent to the East Lake Courts Recreation Center; and 6. All existing easements are retained. SECTION 3.
